COLERAINE BOROUGH COUNCIL BYE-LAWS FOR THE LICENSING AND INSPECTION OF KNACKERS' YARDS

BYE-LAWS made under section 105 of the Public Health (Ireland) Act 1878, incorporating the provisions of the Towns Improvement Clauses Act 1847, and in accordance with section 90 of the Local Government Act (N.I.) 1972 by the Mayor and elected representatives of Coleraine Borough Council for the licensing, and inspection of knackers' yards, for preventing cruelty therein, for keeping the same in a cleanly and proper state, for removing filth at least once in every twenty-four hours, and requiring such knackers' yards to be provided with a sufficient supply of water.

PART 1

Interpretation, Application and Penalties

  • 1. Throughout these bye-laws the expression "the council" means the Coleraine Borough Council.

  • 2. The provisions of these bye-laws shall have effect in relation to every knacker's yard and if any of the provisions thereof are not complied with, the occupier of the knacker's yard concerned shall be liable on summary conviction to a fine not exceeding £100.00 and in the case of a continuing offence to a further fine not exceeding £2.00 for each day during which the offence continues after conviction thereof.

PART 2

Licensing

  • 3. Every person who shall apply to the council for a licence for the erection of any premises to be used and occupied as a knacker's yard shall furnish in the form specified in Schedule 1 a true statement of the particulars therein required to be specified.

  • 4. Every person who shall apply to the council for a licence for the use and occupation of any premises as a knacker's yard shall furnish, in the form specified in Schedule 2 a true statement of the particulars therein required to be specified.

  • 5. Every person to whom the council may have resolved that a licence be granted to erect premises for use and occupation as a knacker's yard shall be entitled to receive from the council a licence in the form specified in Schedule 3.

  • 6. Every person to whom the council may have resolved that a licence be granted for the use and occupation of any premises as a knacker's yard shall be entitled to receive from the council a licence in the form specified in schedule 4.

PART 3

General

  • 7. Every occupier of a knacker's yard shall, when slaughtering, flaying, cutting up or processing is going on and at all reasonable times, afford free access to every part of the premises to any duly authorised officer of the Council for the purposes of inspecting such premises.

  • 8. Every occupier of a knacker's yard shall cause the means of ventilation provided in or in connection with such knacker's yard to be kept at all times in proper order and efficient action so that the air therein is kept in a fresh and wholesome condition.

  • 9. Every occupier of a knacker's yard shall cause the means of lighting provided, both natural and artificial, in or in connection with such knacker's yard to be kept at all times in proper order and efficient action.

  • 10. Every occupier of a knacker's yard shall cause all foul drainage from within the curtilage of the knacker's yard to be piped to a foul sewer or suitable treatment works, and cause the drainage provided in or in connection with such knacker's yard to be kept at all times in proper order and efficient action.

  • 11.
    • (1) Every occupier of a knacker's yard shall cause the internal surfaces of the walls, floors, doors, windows and ceilings of such knacker's yard to be kept clean and to be kept in such good order, repair and condition as to enable them to be effectively cleaned and disinfected, and to prevent any matter being absorbed therein.

    • (2) He shall cause every part of the floors and internal walls on which any blood or liquid refuse or filth may have been spilled or splashed, or with which any offensive or noxious matter may have been brought into contact during the process of slaughtering, flaying, cutting up or processing in such knacker's yard to be thoroughly cleansed and disinfected within three hours after the completion of such slaughtering, flaying, cutting up or processing.

  • 12.
    • (1) Every occupier of a knacker's yard shall cause all equipment and articles used in connection with the slaughtering, flaying, cutting up or processing of animals to be kept in such good order, repair and condition as to enable them to be effectively cleaned and disinfected, and to prevent any matter begin absorbed therein.

    • (2) He shall cause all such equipment or articles to be thoroughly cleansed and disinfected at the end of each day's use and before being re-used when they have been soiled.

  • 13.
    • (1) Every occupier of a knacker's yard shall, within 24 hours of delivery of a carcase or part of a carcase of an animal to the knacker's yard, commence the flaying, cutting up or processing of that carcase or part of that carcase.

    • (2) Every occupier of a knacker's yard shall provide a sufficient number of vessels or portable receptacles, properly constructed of non-absorbent material, and furnished with closely fitting covers, for the purpose of receiving and conveying from such knacker's yard all blood, manure, garbage, filth, or other refuse products of the slaughtering of animals or the cutting up of any carcase on the premises.

    • (3) Every occupier of a knacker's yard shall forthwith upon the completion of the slaughtering of any animal or the flaying, cutting up or processing of a carcase or part of a carcase of any animal brought into such knacker's yard cause such blood, the contents of the stomachs and bowels, manure, garbage, filth or other refuse products to be collected and deposited in such vessels or receptacles and shall cause the contents of such vessels and receptacles to be removed from the premises at least once every twenty-four hours.

    • (4) Every occupier of a knacker's yard shall cause every such vessel or receptacle to be thoroughly cleansed and disinfected immediately after such vessel or receptacle shall have been used for such collection and removal, and shall cause every such vessel or receptacle when not in actual use to be kept thoroughly clean.

    • (5) Every occupier of a knacker's yard shall cause the hide or skin, fat and offal of every animal slaughtered on the premises to be removed therefrom within twenty-four hours after the completion of the slaughtering of such animal.

    • (6) Every occupier of a knacker's yard shall cause the hide or skin, fat and offal of every carcase or part of a carcase of every animal brought into such knacker's yard to be removed therefrom within twenty-four hours after the completion of the flaying, cutting up or processing of such carcase or part carcase.

  • 14.
    • (l) Every occupier of a knacker's yard shall ensure that suitable and sufficient facilities are provided within such knacker's yard as to enable the thorough cleansing and disinfection of all parts of the premises and all equipment and articles used therein.

    • (2) Every occupier of a knacker's yard shall cause the facilities provided in connection with the cleansing and disinfection of the premises, equipment and articles to be kept, at all times, in such proper order, repair and condition as to enable them to be effectively used.

  • 15. Every occupier of a knacker's yard shall provide within the curtilage of such knacker's yard suitable and sufficient facilities for securing the cleanliness of vehicles entering or leaving the said knacker's yard.

  • 16. Every occupier of a knacker's yard shall cause the supply of hot and cold water provided for the purpose of cleansing in accordance with these bye-laws to be adequate, at a suitable pressure, clean and wholesome.

  • 17.
    • (1) Every occupier of a knacker's yard shall cause such action to be taken as is necessary to prevent infestation by insects, rodents or other pests.

    • (2) Every occupier of a knacker's yard shall cause such action to be taken as is necessary to prevent access to any part of such knacker's yard or any material therein or any drainage emanating therefrom by any animal, not being an animal intended for slaughter in the said knacker's yard.

  • 18. Every occupier of a knacker's yard shall not keep or suffer to be kept in a knacker's yard, or in connection with the knacker's yard, elsewhere than in the pounds, stalls, pens or lairs provided, any animal for the purpose of preparation for the process of slaughtering.

  • 19.
    • (1) Every occupier of a knacker's yard shall ensure that every sanitary convenience in such knacker's yard is supplied with water by means of a suitable flushing appliance and the room in which the convenience is situated shall not communicate directly with the slaughterhall, workrooms or storage rooms.

    • (2) Every occupier of a knacker's yard shall ensure that those parts of such knacker's yard containing sanitary conveniences are suitably and sufficiently lighted and adequately ventilated, are constructed so as to ensure that offensive odours from sanitary conveniences do not penetrate to any part of the knacker's yard which may contain meat, and are kept clean.

  • 20.
    • (1) Every occupier of a knacker's yard shall provide suitable and sufficient wash-hand basins for the use of all persons working in or about such knacker's yard, and ensure that an adequate supply of hot and cold water or of hot water at a suitably controlled temperature and an adequate supply of soap or other suitable detergent, nailbrushes and clean towels or other suitable drying facilities are supplied at every such wash-hand basin.

    • (2) Every occupier of a knacker's yard shall ensure that hand-washing facilities are provided as close as possible to the work-stations of persons in the knacker's yard and within those parts of the knacker's yard containing sanitary conveniences.

    • (3) Every occupier of a knacker's yard shall ensure that any hand-washing facilities provided under this bye-law shall not be used for any purpose other than for securing the personal cleanliness of the user.

PART 4

Personal Hygiene and Conduct

  • 21.
    • (1) Every person in a knacker's yard who engages in the handling of knacker meat or is liable to come into contact with any knacker meat, equipment or facilities provided in connection with such knacker's yard shall keep as clean as may be reasonably practicable all parts of his person liable to come into contact with such knacker meat, equipment or facilities provided, and shall wear adequate protective clothing which shall be kept as clean as may be reasonably practicable.

    • (2) No person shall urinate, defecate or spit in a knacker's yard except in a sanitary convenience.

    • (3) Every person using any knife, scabbard, sharpening steel, chopper, saw or other equipment coming into contact with meat in a knacker's yard shall ensure that it is kept clean and kept in such good order, repair and condition as to enable it to be effectively cleaned and disinfected.

    • (4) He shall cause all such articles or equipment used by him to be thoroughly cleansed and disinfected at the end of each day's use and before being re-used when they have been soiled.

    • (5) Suitable and sufficient bandages, dressings, including waterproof dressings, for first-aid treatment shall be provided and maintained on the premises.
